Auckland Short-Stay Accommodation - Booking Terms and Conditions

These Booking Terms and Conditions apply to all short-stay accommodation bookings made with Auckland Short-Stay Accommodation, operated by Kauri Tree Investments Limited, for our furnished executive accommodation in Te Atatū Peninsula, Auckland. By making a booking, paying a deposit, submitting a booking request, occupying the accommodation, or allowing any guest to occupy the accommodation, you agree to these Terms and Conditions. These terms are intended for website use and booking administration.

1. Definitions

In these Terms and Conditions:

“Accommodation” means the short-stay furnished townhouse, apartment, dwelling, or property made available by Auckland Short-Stay Accommodation.

“We”, “us” or “our” means Auckland Short-Stay Accommodation and/or Kauri Tree Investments Limited.

“Guest”, “you” or “your” means the person making the booking and any person staying at, visiting, or using the Accommodation during the booking period.

“Booking” means an agreed short-stay accommodation arrangement between us and the Guest.

“Booking Period” means the confirmed arrival and departure dates.

“Fees” means the accommodation charge, cleaning fee, bond, extra guest charges, late checkout charges, damage charges, and any other agreed charges.

2. Nature of Accommodation

Auckland Short-Stay Accommodation provides furnished, short-stay executive accommodation in Te Atatū Peninsula, Auckland.

The Accommodation is offered for short-term stays only. It is not intended to create a residential tenancy, lease, boarding house arrangement, or long-term occupation right.

Unless otherwise agreed in writing, the Accommodation must only be used for temporary accommodation, business travel, relocation stays, family visits, holiday accommodation, or similar short-stay purposes.

The Guest acknowledges that no landlord and tenant relationship is intended.

3. Booking Requests and Confirmation

A booking request may be submitted through our website, by email, phone, or any other method accepted by us.

A booking is not confirmed until:

  1. We have accepted the booking in writing; and

  2. Any required deposit, bond, or upfront payment has been received; and

  3. We have confirmed the Accommodation, dates, number of guests, and Fees.

We may decline any booking request at our discretion.

We may require identification, contact details, payment details, or other information before confirming a booking.

4. Guest Numbers and Approved Occupants

Only the number of guests approved in the booking confirmation may stay at the Accommodation.

The Guest must not allow extra people to stay overnight without our prior written approval.

The Accommodation must not be used for parties, events, gatherings, commercial activity, filming, subletting, or any other purpose not approved by us in writing.

If additional guests stay without approval, we may charge additional fees, cancel the booking, require the Guest to vacate, or deduct costs from the bond.

5. Payment Terms

The Guest must pay all Fees by the dates specified in the booking confirmation or invoice.

Unless otherwise agreed in writing, we may require:

  1. A deposit to secure the booking;

  2. Full payment before arrival;

  3. A refundable bond or security deposit; and

  4. Payment of any cleaning fee or other applicable charges.

If payment is not received by the due date, we may cancel the booking and retain any non-refundable amounts in accordance with these Terms and Conditions.

6. Bond and Security Deposit

We may require a bond or security deposit before check-in.

The bond may be used to cover:

  1. Damage to the Accommodation, furniture, fittings, appliances, linen, keys, access devices, or contents;

  2. Excess cleaning;

  3. Lost keys, lockouts, or replacement access devices;

  4. Unauthorised guests;

  5. Smoking, vaping, odours, or specialist cleaning;

  6. Noise complaints, call-out fees, fines, or penalties;

  7. Late checkout charges;

  8. Breach of these Terms and Conditions; and

  9. Any other loss, cost, or expense caused by the Guest or their visitors.

The bond does not limit the Guest’s liability. If the cost of damage, loss, cleaning, or other charges exceeds the bond, the Guest must pay the additional amount on request.

Subject to inspection and deduction of any applicable charges, the bond will be returned within a reasonable period after checkout.

7. Cancellations and Amendments

All cancellation or amendment requests must be made in writing.

We may accept or decline a requested amendment at our discretion, including changes to dates, duration, guest numbers, or Accommodation.

Unless otherwise stated in the booking confirmation, the following cancellation terms apply:

  1. If the Guest cancels more than 28 days before arrival, the deposit may be retained, but any balance paid may be refunded.

  2. If the Guest cancels 28 days or fewer before arrival, the full accommodation fee may remain payable.

  3. If the Guest fails to arrive, checks in late, or departs early, no refund is payable unless we agree otherwise in writing.

  4. If we are able to rebook the Accommodation for the cancelled dates, we may, at our discretion, refund part of the Fees after deducting reasonable costs, administration fees, and any difference in nightly rate.

We recommend guests arrange appropriate travel insurance to cover cancellations, delays, illness, emergencies, or other unexpected events.

8. Cancellation by Us

We may cancel a booking if:

  1. The Guest fails to pay any amount when due;

  2. The Guest provides false or misleading information;

  3. We reasonably believe the booking may breach these Terms and Conditions;

  4. The Accommodation becomes unavailable due to damage, maintenance, sale, legal restriction, safety issue, emergency, or circumstances beyond our control; or

  5. The Guest or their visitors behave in a way that causes disturbance, damage, risk, or nuisance.

If we cancel before arrival for reasons not caused by the Guest, we will refund amounts paid for unused accommodation. We will not be liable for additional costs, travel costs, alternative accommodation, loss of enjoyment, or consequential loss.

9. Check-In and Check-Out

Unless otherwise agreed in writing:

Check-in: from 2.00 pm on the day of arrival
Check-out: by 10.00 am on the day of departure

Early check-in or late checkout may be available by prior written agreement and may incur an additional charge.

The Guest must follow all check-in, key collection, lockbox, access, parking, and departure instructions provided by us.

If the Guest does not vacate by the agreed checkout time, we may charge a late checkout fee and any additional costs incurred, including cleaning delays or impact on the next booking.

10. Use of the Accommodation

The Guest must:

  1. Keep the Accommodation clean, tidy, secure, and in good condition;

  2. Use all appliances, fittings, furniture, and facilities properly and safely;

  3. Report any damage, breakage, maintenance issue, or safety concern as soon as possible;

  4. Lock doors and windows when leaving the Accommodation;

  5. Comply with all reasonable house rules and instructions;

  6. Respect neighbours and the residential nature of the area;

  7. Comply with all laws, council requirements, fire safety obligations, and body corporate or community rules; and

  8. Leave the Accommodation in a reasonable condition on departure.

The Guest must not:

  1. Smoke or vape inside the Accommodation;

  2. Use candles, incense, open flames, or hazardous materials;

  3. Move furniture without approval;

  4. Remove any items from the Accommodation;

  5. Cause excessive noise, nuisance, disturbance, or anti-social behaviour;

  6. Bring pets unless approved in writing;

  7. Conduct parties, events, functions, or gatherings;

  8. Use the Accommodation for unlawful activity;

  9. Sublet, assign, or transfer the booking; or

  10. Interfere with smoke alarms, security devices, Wi-Fi equipment, locks, or safety systems.

11. Smoking, Vaping and Odours

The Accommodation is strictly non-smoking and non-vaping indoors.

If smoking, vaping, strong odours, or evidence of smoking is detected inside the Accommodation, the Guest may be charged for specialist cleaning, deodorising, replacement linen, lost income, and any other associated costs.

Any outdoor smoking area, if approved, must be used respectfully and all cigarette butts and rubbish must be removed.

12. Cleaning and Rubbish

A standard clean is included or charged as part of the booking, as confirmed at the time of booking.

The Guest must leave the Accommodation in a reasonable state, including:

  1. Washing or stacking dishes as instructed;

  2. Removing food from the fridge and pantry unless otherwise agreed;

  3. Placing rubbish and recycling in the correct bins;

  4. Leaving used towels and linen as instructed; and

  5. Reporting any spills, stains, damage, or breakages.

Excess cleaning, rubbish removal, stain treatment, odour removal, or specialist cleaning may be charged to the Guest.

13. Damage, Loss and Guest Liability

The Guest is responsible for all damage, loss, breakage, excessive wear, missing items, specialist cleaning, fines, penalties, third-party charges, and costs caused by the Guest or their visitors during the Booking Period.

This includes damage to the Accommodation, furniture, appliances, fixtures, fittings, linen, towels, keys, access devices, outdoor areas, neighbouring property, common areas, and building facilities.

The Guest agrees to reimburse us for all reasonable costs, including repair, replacement, labour, administration, contractor call-outs, lost income, legal costs, debt collection costs, and other losses arising from breach of these Terms and Conditions.

14. Keys, Access and Security

The Guest is responsible for all keys, remotes, fobs, access codes, and lockbox details provided.

Lost keys, damaged keys, lockouts, locksmith attendance, replacement locks, replacement access devices, or compromised access codes may be charged to the Guest.

The Guest must not copy keys, share access codes with unauthorised persons, or allow unapproved guests to access the Accommodation.

15. Wi-Fi, Utilities and Services

Wi-Fi and utilities may be provided for reasonable guest use.

We do not guarantee uninterrupted internet, power, water, telecommunications, streaming services, or other third-party services.

The Guest must not use the internet or utilities for unlawful, excessive, unsafe, or unreasonable purposes.

We are not liable for service interruptions, outages, faults, maintenance issues, or failures caused by third-party providers or events outside our reasonable control.

16. Maintenance and Access

We may access the Accommodation during the Booking Period where reasonably required for inspection, repairs, maintenance, safety, emergency, cleaning, compliance, or suspected breach of these Terms and Conditions.

Where practical, we will provide reasonable notice before accessing the Accommodation. In an emergency or where urgent access is required, we may enter without prior notice.

The Guest must promptly notify us of any maintenance issue, safety concern, leak, damage, electrical issue, appliance fault, pest issue, or other problem.

17. Personal Belongings

The Guest is responsible for their own belongings, vehicles, valuables, travel documents, equipment, and personal items.

We are not responsible for loss, theft, damage, or misplacement of personal belongings, except where required by law.

Items left behind may be returned at the Guest’s cost where practical. Unclaimed items may be disposed of after a reasonable period.

18. Parking and Vehicles

Any parking arrangements will be confirmed at the time of booking or in check-in instructions.

Vehicles are parked at the Guest’s own risk.

The Guest must not block driveways, neighbouring properties, footpaths, shared accessways, garages, or emergency access.

Any parking fines, towing costs, damage, or complaints caused by the Guest or their visitors are the Guest’s responsibility.

19. Pets

Pets are not permitted unless approved by us in writing before arrival.

If a pet is approved, the Guest is responsible for all cleaning, odour removal, damage, noise, nuisance, and any other costs associated with the pet.

Unauthorised pets may result in cancellation of the booking, additional cleaning charges, and deduction from the bond.

20. Complaints and Issues During Stay

If the Guest is dissatisfied with the Accommodation or experiences an issue, they must contact us as soon as possible during the stay so we have a reasonable opportunity to investigate and resolve the matter.

Complaints made after departure may be more difficult to assess and may not be accepted where we were not given an opportunity to remedy the issue during the stay.

Any unresolved complaint must be provided in writing within 14 days after checkout.

21. Health, Safety and Guest Responsibility

The Guest must take reasonable care for their own health and safety and the safety of their visitors.

The Guest must comply with all safety notices, house rules, fire safety instructions, appliance instructions, and reasonable directions.

The Guest must not tamper with smoke alarms, fire extinguishers, locks, security devices, electrical equipment, gas fittings, plumbing, or safety systems.

Any injury, incident, hazard, or safety concern must be reported to us promptly.

22. Insurance

The Guest must not do anything that may invalidate, prejudice, or adversely affect any insurance policy relating to the Accommodation or its contents.

The Guest is responsible for their own travel insurance, personal belongings insurance, vehicle insurance, business equipment insurance, and any other insurance they require.

The Guest agrees to reimburse us for any loss, damage, excess, uninsured loss, or increased insurance cost caused by the Guest or their visitors.

23. Limitation of Liability

To the maximum extent permitted by law, our liability to the Guest is limited to the amount paid by the Guest for the affected booking.

We are not liable for indirect loss, consequential loss, loss of income, loss of business, loss of profit, loss of opportunity, loss of enjoyment, travel disruption, alternative accommodation costs, or other losses arising from or connected with the booking, except where required by law.

Nothing in these Terms and Conditions limits any rights or remedies that cannot be excluded under New Zealand law.

24. Consumer Guarantees Act 1993

Where the Accommodation is acquired for personal, domestic, or household use, the Guest may have rights under the Consumer Guarantees Act 1993.

Where the Accommodation is acquired for business purposes, the parties agree, to the extent permitted by law, that the Consumer Guarantees Act 1993 does not apply.

Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any non-excludable legal rights.

25. Privacy

We collect personal information to manage booking enquiries, confirm reservations, process payments, communicate with guests, manage accommodation access, verify identity where required, resolve disputes, recover unpaid amounts, and operate our accommodation business.

Personal information may include name, contact details, booking details, payment information, identification information, vehicle details, communications, and other information reasonably required for the booking.

We may share personal information with our staff, contractors, cleaners, property managers, payment providers, professional advisers, insurers, debt collection agencies, law enforcement, regulatory bodies, or other parties where reasonably necessary for the operation of the accommodation business or where required by law.

Personal information will be handled in accordance with the Privacy Act 2020.

Guests may request access to, or correction of, their personal information by contacting us.

26. Website Information and Availability

We aim to keep our website information, pricing, availability, photos, descriptions, and property details accurate and up to date.

However, availability, pricing, furnishings, layout, features, and services may change from time to time.

Photos are indicative only and may not show every feature, item, or current configuration.

A booking is only confirmed when accepted by us in writing.

27. Force Majeure

We are not liable for delay, cancellation, non-performance, or failure to provide the Accommodation where caused by events beyond our reasonable control.

This may include natural disasters, severe weather, fire, flood, earthquake, pandemic, government restriction, utility failure, emergency works, building damage, illness, transport disruption, civil disturbance, or other events outside our control.

Where a force majeure event affects a booking, we may offer a refund, credit, amendment, or cancellation depending on the circumstances, legal requirements, and amounts already incurred.

28. Breach of Terms

If the Guest breaches these Terms and Conditions, we may:

  1. Cancel the booking;

  2. Require the Guest and visitors to leave immediately;

  3. Retain all or part of the bond;

  4. Charge additional costs;

  5. Refuse future bookings;

  6. Recover losses, damage, cleaning costs, fines, or legal costs; and

  7. Take any other action available at law.

No refund is payable where a booking is cancelled or terminated due to Guest breach.

29. Disputes

If a dispute arises, the parties agree to first try to resolve the matter in good faith by discussion.

If the dispute cannot be resolved, either party may refer the matter to mediation or another appropriate dispute resolution process.

Nothing in this clause prevents either party from seeking urgent legal relief or using any rights available under New Zealand law.

30. Governing Law

These Terms and Conditions are governed by the laws of New Zealand.

The parties submit to the jurisdiction of the New Zealand courts.
